IP ALERT LAVOIX Munich - March 2014: EPO announces raise of fees FROM APRIL 1ST, 2014
According to an EPO Administration Council Decision of December 13th, 2013, the EPO's fee schedule and rules relating to fees will be revised in 2014. The decision was published on December 20th, 2013 on the EPO website. The new schedule and rules relating to fees enter into force on April 1st, 2014. They are generally applicable to payments made on or after April 1st, 2014, with some exceptions.
The reviewed fees show generally an increase of between 4% and 5%.
Significant raises concern in particular the fees for:
- Fee for a technical opinion, which will be increased from 3695 EUR to 3860 EUR
(+165 EUR, 4,4%),
- Search fee in respect of a European or supplementary European search for an application filed on or after 1 July 2005, increased from 1165 EUR to 1285 EUR (+ 120 EUR; +10%),
- Fee for appeal increased from 1240 EUR to 1860 EUR (+620 EUR; +50%).
As a consequence, in case procedural steps for EPO patents or patent applications are due in mid-2014 or in case you wish to use any of the EPO's services concerned by the fee raise, especially the search fee which is due for a PCT when the EPO was not the international searching authority, it can be worthwhile to take the necessary steps so that the respective fee can be paid before April 1st, 2014.
