A NEW FRAMEWORK FOR FILING OPPOSITIONS IN FRANCE

 

Since 4 June 2015, an opposition may be filed in France based on the name, image or reputation of a local authority or a geographical indication or an AOC, PDO or GI, in addition to a trademark.

To use one of these prior rights to file an opposition, it will nevertheless be necessary to provide the following evidence:

  • Documents that prove that the local authority is identified by way of the sign at issue, or
  • A copy of the approval of the specifications for geographical indications with respect to industrial or commercial products, or
  • For AOC, PDO and GI, documents that prove the protection thereof.


In this regard, we draw your attention to the creation of a new category of rights, the "geographical indications", which allows for the identification of manufactured products.
