Changes to the Board of Appeals of the EPO
Discussions about a reform of the Board of Appeals of the EPO have been ongoing during quite some time. In July 2016, the Administrative council of the European Patent Organization agreed to a reform.
The reform seeks to achieve greater independency to the Board of Appeals from the European Patent Office.
The measures include restructuring of the Board of Appeals into a separate Board of Appeals Unit that will be headed by a newly appointed president. The Unit only reports to the Administrative Council and not anymore to the EPO President. Another measure taken is the physical separation of the Board of Appeals Unit from the EPO.
In December, the decision for the new location of the Board of Appeals Unit was taken. It will be located in the outskirts of Munich at the 8inOne Building; Richard-Reitzner-Allee 8; 85540 Haar; Germany.
The move to the new location is planned for July 2017. For the users of the EPO system this means that oral proceedings before the Board of Appeals are not anymore in the Isar-Building of the EPO, but in the new 8inOne building.
The first president of the Board of Appeals Unit will be former Senior Judge of Appeal at the Svea Court of Appeal in Stockholm, Carl Josefsson (Sweden), who will take up his position March 1st, 2017.
