Resumption of proceedings following the decision G 1/19

On 10 April 2019, the President of the European Patent Office (EPO) decided to stay all proceedings before EPO examining and opposition divisions in which the decision depended entirely on the outcome of the Enlarged Board of Appeal's decision on referral G1/19. Many European patent applications were concerned by this stay. 

As we have reported in our IP Alert of March 2021, the EPO has decided that the established case law on computer-implemented inventions (COMVIK approach) also applies to computer-implemented simulations. This decision has been issued on 10 March 2021 by the Enlarged Board of Appeal.

 

As a consequence, the President of the EPO has decided to lift the stay with effect from 11 March 2021. The proceedings will be gradually resumed. The EPO issues a communication informing the applicant about the resumption of the proceedings.
