Copyright

Your copyrights, at their true value

A creation may, under certain conditions, be protected under both copyright and design law.

Lavoix analyses and studies the possibility of securing protection, particularly in the context of a pre-litigation or litigation action.

Lavoix thus assists you in acquiring copyrights, in drafting and negotiating transfers or licences of rights and in creating proof of the definite date of creation (time-stamping, sealed envelope, bailiff’s report, Soleau envelope, escrow, or other method).

Monitoring the content of Internet sites and press materials also makes it possible to stay informed about the creations of your competitors and their filings in the same field of business.

FAQ

Copyright protects works of the mind, such as:

  • Literary works (novels, poems, articles, etc.)
  • Artistic works (paintings, drawings, photographs, sculptures, etc.)
  • Sound and audiovisual works (films, music, etc.)
  • Applied art works (architecture, designs)
  • Software and databases

Copyright is automatically granted upon creation of the work, but it is subject to certain conditions.
The work must be original, meaning it is an independent creation (not a copy) that reflects the author’s personality.
Works protected under copyright law in Anglo-Saxon countries are often marked with the symbol ©.

Copyright grants two types of rights:

Property rights

Moral rights:
attached to the author and inalienable

  • Right of representation
  • Right of reproduction
  • Right of authorship
  • Right to respect for the work
  • Right of disclosure
  • Right of withdrawal and repentance

To protect your works, several options are available to obtain official, dated proof of creation:

  • Online deposit via which timestamps your creations
  • Deposit a copy with a notary public or a bailiff
  • Use our online timestamping tool easystamp, available through our IP data² platform

Lavoix supports you in all your copyright protection procedures, from acquisition of rights to defense in infringement actions. For any questions, contact us.

In principle, copyright protects a work throughout the author’s lifetime and for 70 years after his/her death.
